Enjoy Apartments is part of the Spanish company Enjoy Holidays S.L. which manages (holiday) rental booking sites in different destinations, such as Barcelona, Madrid, Andorra, Rotterdam, Curaçao and Rio de Janeiro.

Our terms and conditions apply to booking sites in all destinations. Note that for translation purposes, our English version is always the current version and prevails over all other languages.

Booking process

You have completed a reservation request on our site. To confirm your reservation request, you will be asked to pay a reservation deposit. We also need some personal data, for more information see "Privacy Statement".

The Reservation Deposit must be paid instantly when the reservation of accommodation on the website is completed. The reservation will not be converted into a reservation until Enjoy Apartments has received the amount of the reservation deposit and a completed personal data form. When both are received by Enjoy Apartments, the information is sent to the owner of the accommodation for their final approval. Thus, we avoid overbookings. After the owner's final approval, we will send you an email with the final booking confirmation.

By making a reservation, the potential customer concludes a contract in accordance with the general conditions and will be called customer from now on.

By making a reservation with Enjoy Apartments, the client also accepts the general terms and conditions of the owner, which are set out in the short-stay rental agreement of the chosen accommodation. Upon your arrival, the accommodation manager will ask you to sign these terms and conditions. If you would like to read the short stay rental agreement before your arrival, please send us an e-mail and we will provide it to you. Reservation Deposit The amount of the Reservation Deposit will be indicated in the e-mail that will be sent to you or displayed online when booking. It is usually around 15-30% of the total amount of your stay, excluding all additional charges and the refundable security deposit. The total amount of this reservation deposit must be paid by bank transfer or credit card to ENJOY HOLIDAYS S.L.. The bank account number will be provided to you in an e-mail. When choosing a bank transfer, you must scan a copy of the bank slip and send it to the email address: bookarrobaenjoy-apartments.com. Note that we can only hold a reservation for 24 hours from the time of your reservation request. Make sure to send us the bank statement within this time as we may cancel your reservation and rent the accommodation to other guests.

Final booking confirmation

When Enjoy Apartments has received the copy of the bank slip as proof of your bank transfer, we will send you our final booking confirmation by e-mail after final agreement from the owner. The reservation is then considered confirmed and a valid contract is established.

The client must verify that all the information contained in the final booking confirmation email is correct and must inform Enjoy Apartments within three days of any changes. Failure to notify us within this time will mean the client accepts the booking as stated. The correction of errors due to typos or calculation errors is reserved for Enjoy Apartments.

The customer is responsible for all the obligations that arise from the contract and will be responsible for all the people included in his reservation. The final booking confirmation shows the balance due upon arrival. You will also find attached the exact address of the accommodation, as well as the name and telephone number of the accommodation manager. Please contact him upon arrival or during your stay if you have any questions.

Change requests

In the event that the customer wishes to modify a reservation more than three days after having received the definitive reservation confirmation, Enjoy Apartments will charge a processing fee of €25 outside of any price increase.

Naturally, we will do our best to accommodate your change requests. However, we cannot guarantee that we will achieve this and Enjoy Apartments accepts no responsibility for any additional expenses, loss or damage that may occur. A change of accommodation is not possible and is not considered as a modification but as a cancellation. A new reservation must be made for this purpose within 3 days of the initial reservation so that the reservation deposit can be reused. After this time, the Reservation Deposit will be lost. All changes must be made by e-mail or fax. Changes over the phone are not accepted.

Balance due on arrival

The balance due upon arrival must be paid in cash directly to the accommodation manager upon arrival. It must be paid in the local currency. Except for the Curaçao destination where it is necessary to pay the balance in advance (4-6 weeks before arrival).

If you wish to pay the balance due upon arrival by bank transfer, the fee will be 2.5% on top of the balance due. The total sum must be received at least 7 days before arrival. The refundable security deposit cannot be transferred by bank and must always be paid in cash on arrival.

In some cases, payment of the balance due may be made by credit card, which incurs an additional charge of 3% (Visa or MasterCard) or 4% (American Express). For more information, contact us.

In some cases, payment of the balance due on arrival can also be made by bank transfer provided that:

the corresponding net amount is received in our bank account 1 week before arrival (bank charges are to be borne by the client)
we have confirmed receipt of this amount in writing
In some cases, mainly for longer stays, the owner has the right to charge the first month's rental in advance, before the arrival date.

Refundable security deposit

The refundable security deposit is given as a guarantee to ensure that no damage is caused to the accommodation.

The refundable security deposit for accommodation will be approximately between €150 and €500 and depends on the accommodation chosen.

The refundable security deposit must be given to the accommodation manager upon arrival. Except for the Curaçao destination where the refundable security deposit is due in advance at the same time, the balance must be paid (4 to 6 weeks before arrival). When staying in one of our rentals in Curacao, the refundable security deposit will be returned to you after departure (within two weeks) and, in some cases, water and electricity consumption is deducted from the deposit of guarantee. Enjoy Apartments does not collect or distribute refundable security deposits and does not engage in refundable security deposits in any way. We cannot be held responsible for the loss of a refundable security deposit for any reason, nor can we be held liable in any way due to any dispute arising from a refundable security deposit.

The accommodation manager has the right to refuse admission to guests who do not pay the refundable security deposit if required. On the day of the guest's departure, the accommodation manager is obliged to refund the security deposit (this excludes claims made for possible damage caused) only after checking the accommodation. In the event that an Accommodation Manager/Owner retains part or all of the deposit, they are required to submit a written report of the damage incurred to justify the retention of the refundable deposit to Enjoy Apartments.

Tourist tax

Each guest from the age of 17 will be charged a tourist tax. Fees may vary by city. Find out before booking. In Barcelona the charge will be 2.48 euro cents per person/per night up to 7 nights.

payment methods

For the reservation deposit, we accept payment by credit cards (Visa, Eurocard/Mastercard via our own bank, Amex via Paypal) and by bank transfer.

The balance due on arrival is in cash for all destinations except Curaçao where payment must be made in advance. In some cases, this can be done in advance by bank transfer or credit card. For more information, contact us.

Currency

Prices shown are in Euros (€) based on rates in effect at time of printing and are subject to change without notice.

Invoices

If an invoice is required for the full amount of a reservation, please contact us before making the reservation.

Cancellation Policy

Any cancellation, including force majeure, will be subject to our cancellation policy. All cancellations must be made by e-mail or fax. We do not accept cancellations by phone.

# Cancellations less than 30 days before arrival: 50% of the total balance must be paid.
# Cancellations less than 7 days before arrival or no show: 100% of the total balance must be paid.

Please note that the reservation deposit is not refundable under any circumstances. The remaining balance, once paid, is also non-refundable.

Booking cancellations made by Enjoy Apartments or by the owner

Enjoy Apartments rents accommodation on the basis of a calendar managed by the owner. Enjoy Apartments is not responsible for the unavailability of the accommodation which could be due to an overbooking of the accommodation caused by the owner. In this case, or if due to any other problem, the accommodation you have booked is not available, we will do our best to offer you another option at the same or similar price. If you do not accept our offer, we will refund the reservation deposit and we reserve the right to cancel the contract unilaterally.

force majeure

All accommodation featured on Enjoy Apartments websites is subject to local laws and legal conventions. If, due to the modification of these laws, consequences should arise for the short-stay rental agreement, Enjoy Apartments will try to find alternative accommodation for the client that meets the standards of the accommodation initially booked. If the client does not agree or no similar offer can be made and the balance due on arrival has already been transferred to the owner, the owner will return the payment. Enjoy Apartments accepts no responsibility for changes in local laws and legal conventions regarding vacation rentals and their consequences for the client or owner. Compensations will not take place.

Arrival departure

To avoid unnecessary waiting for each other, we ask that you call your accommodation manager DIRECTLY UPON ARRIVAL at the airport or at the alternative arrival location you indicated when booking. The manager's name and phone number are listed in the final booking confirmation email. If you come by car, train or bus, we ask that you call us approximately 45 minutes before your scheduled arrival at the accommodation. You will then be asked to meet your manager at the accommodation to receive the keys against payment of the balance due in cash in the local currency.

Accommodation is available from 3 p.m. on the date of arrival. If you plan to arrive earlier, you must inform the accommodation manager or Enjoy Apartments in time so that a solution for your luggage can be found.

When you arrive before 3 p.m. it is not always possible to check in directly at the accommodation. Sometimes other guests leave and the accommodation needs to be cleaned before you arrive.

The departure will take place before 11:00 am. A representative of Enjoy Apartments or the accommodation manager will check the accommodation for any damages, collect the keys from you and return the full security deposit if there are no damages.

Supplement for early/late arrivals and departures

In case of arrival after 9 p.m. a late check-in fee of €30 may apply. After midnight, this fee is €50. If you need to leave the accommodation before 9:00 am, additional costs may be charged by the accommodation manager. If this is your case, please inform the accommodation manager or Enjoy Apartments directly and ask if there are any additional check-out charges.

Key

The keys to the accommodation will be given to you upon your arrival at the accommodation. The responsibility for the keys is then yours and you are required to take care of them. If you lose keys during your stay you will be charged for replacement and any lock fittings that need to be done. This will be deducted from your refundable security deposit.

Cleaning

The accommodation will be cleaned before your arrival. We expect you to take care of the accommodation and equipment provided in a responsible manner and to carry out daily cleaning in order to maintain it properly. It is your responsibility to take out your own waste and leave it in the designated place inside the building or in the containers you will find on the street. When staying longer than a week, an additional cleaning session may be offered or is mandatory, please check the accommodation description or inform Enjoy Apartments. Requests should ideally be made prior to your arrival.

During your stay

We expect you to take care of housing and the environment responsibly. Since most of the accommodation is located in residential buildings, neighbors and residents. 

Local time itudes must be respected and the noise level controlled inside or outside the accommodation, in the stairwell and in front of the building. LOUD PARTIES, LOUD MUSIC, SCREAMING, SLAMMING DOORS AND ANY OTHER TYPE OF EXCESSIVE NOISE ARE ABSOLUTELY PROHIBITED. Any immoral or illegal activity is prohibited. All damages must be reported as soon as possible to the apartment manager and at the latest when leaving the accommodation. Depending on the damage, the manager/owner of the apartment will charge you for the repairs.

The client booking the accommodation is responsible for the good behavior of all members of his group. In case of problems due to inappropriate or irresponsible behavior, the apartment manager is entitled to ask the client to leave the accommodation immediately, without any compensation and possibly without returning the refundable security deposit. All additional expenses i.e. police fines etc. must be paid by the customer. By booking accommodation through Enjoy Apartments, the client accepts these Terms & Conditions.

Number of guests

The number of guests must be the same as indicated in the reservation. It is not permitted to have more people staying in the accommodation as agreed and paid for. During a stay in accommodation with a baby, there is the possibility of having a cot in the accommodation. Please let us know when you are interested in renting a cot.

Children

As a courtesy of the owners and in agreement with Enjoy Apartments, children under 3 are generally free and children under 12 pay half the adult price. By saying "less" means that the children on the day of arrival are not yet 3 years old or 12 years old respectively. In case there is more than one child under 3 years old, the owner reserves the right to apply a supplement.

Please check before booking and/or consult Enjoy Apartments to rule out possible issues when checking in.

For reservations concerning the Curacao destination, we strongly advise you to consult Enjoy Curacao before booking accommodation with children as there is no general price policy managed by the owners. Enjoy Apartments declines all responsibility in the event of a financial problem between the client and the owner after the reservation. Any additional costs that may arise for bringing young children that have not been previously communicated to Enjoy Apartments / Enjoy Curacao or the owner must be paid by the guest.

Pets

In general, none of our accommodations allow you to bring pets. This is because of many people's allergy to them. If you wish to bring a pet, please always ask us in advance.

Passives

Enjoy Apartments provides an online reservation service which is limited to the presentation of the accommodations as well as the communication concerning the reservation which results in the Final Confirmation of Reservation.

Therefore, Enjoy Apartments is not responsible for any accidents, losses, damages, delays, changes in schedules or prices related to the services of our suppliers. This also includes errors and omissions, misinterpretations, disputes between the customer and third parties.

Enjoy Apartments is not part of the short-term rental contract and negotiates on behalf of the owner. Any complaints arising during the stay should be addressed directly to the manager/owner of the apartment. In the event of difficulties in contacting them, Enjoy Holidays will do its best to help resolve the problem, but cannot be held responsible. All complaints should be voiced pending, complaining after a certain time or after leaving does not make sense. All issues related to refunds should be resolved between the guest and the apartment manager/owner.

Neither Enjoy Apartments nor the manager/owner of the apartment are responsible for any direct or indirect damage that may result from your stay in your Enjoy Apartments accommodation. This includes damage, insurance, loss due to fire, theft or criminal behavior, or personal injury. We recommend that all travelers take out travel insurance.

Commercial Network

Enjoy Apartments intermediates and manages directly apartments and distributes those in her commercial network. The commercial network includes websites owned by Enjoy Apartments as also third party holiday rental or midstay platforms and websites.

Dispute

Enjoy Apartments is a subsidiary of Enjoy Holidays S.L. which is located in Barcelona, Spain. In the event of a dispute arising from the reservation of accommodation by Enjoy Apartments, the courts of Barcelona (Spain) will have sole jurisdiction to hear such matters and the Spanish law in force at the time will be applied.
